Diamond Service Grading Terms and Conditions of Services

By utilizing our services, you agree to be bound by the terms and conditions set forth in this Agreement. These terms and conditions apply to the services (“Services”) ordered by you (“Customer”) and described in a submission form (“Submission Form”):

1. Services Provided

1.1 Card Grading: We will evaluate and grade the condition of collectible cards based on industry-standard grading criteria.

1.2 Authentication: We will authenticate the collectible cards to verify their genuineness and provide a certificate of authenticity.

1.3 Turnaround Time: We will make best efforts to complete the grading and authentication process within a reasonable timeframe. However, unforeseen circumstances may affect turnaround times.

2. Submission Guidelines

2.1 Submission Requirements: Customer agrees to submit cards in accordance with our submission guidelines, including packaging and labeling instructions.

2.2 Ownership: Customer confirms that they are the legal owner of the submitted cards or have the authority to act on behalf of the owner.

2.3 Tampering: Customer represents and warrants that it has no knowledge and no reasonable basis for belief that any collectible submitted is not genuine or contains any non- disclosed alterations or restorations, including, but not limited to, trimming, re-coloring, bleaching, power erasing, re-backing, artificially toning, applying or removing punches or stamps, or any other method used to change or enhance the appearance, condition, or content of a collectible (collectively “Tampering” or “Tampered”). Customer acknowledges that Tampering is wrongful, and violations of this Section 2.3 shall entitle Company to compensatory damages and injunctive relief, as appropriate.

2.4 Our company has the right in its sole discretion to reject any collectibles submitted for Services in cases where the submitted collectibles do not comply with our current standards and procedures set forth on our website. Because even collectibles that are ultimately rejected must still be received, tracked, and examined, fees for services shall not be refunded for such rejected collectibles.

3. Fees and Payments

3.1 Fees: Customer agrees to pay the applicable fees for grading and authentication services as per our fee schedule, which is available on our website.

3.2 Payment: Customer agrees payment of all services is due at the time of submission. Prices for services are subject to change. We accept payment through the methods specified on our website.

4. Disputes and Corrections

4.1 Disputes Resolution: Our company holds the discretion to address disputes, including any damages incurred during services and/or mislabeled cards.

4.2 Correction Criteria: In the event that any card falls within our criteria for correction, we commit to rectifying the issue at no additional cost to the customer.

5. Limitation of Liability

5.1 Exclusions: In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.

5.2 Maximum Liability: Our maximum liability for any claims arising out of or related to this Agreement shall be limited to the total amount paid by you for the specific services giving rise to the claim.

5.3 Customer assumes all risk of loss or damage to collectibles until collectibles are received and inspected by our company. Provision of Services commences upon receipt of a submission of collectibles from Customer.

5.4 Non-Responsibility for Damages: Our card holders are intentionally designed to be tamper-resistant to maintain the integrity of the grading and authentication process. We explicitly disclaim any responsibility for damages that may occur if the card holders are removed or tampered with. Any such damages incurred during or after removal of the card
holder will not be the responsibility of our company.

5.5 Shipping: In the event of a claim for loss or damage during return shipping, the basis for valuation shall be the fair market value of the collectibles at the time of loss, as determined by an independent appraiser, not to exceed the Customer’s declared value. Customer assumes risk of loss or damage to collectibles during return shipment to the extent the declared value of any package exceeds the insurance limits. Insurance coverage is based on a collectible’s fair market value, not to exceed Customer’s declared value.

By using our services, you acknowledge that you have read, understood, and agree to be bound by these terms and conditions. This Agreement constitutes the entire understanding between the parties and supersedes all prior agreements.
